Go Privilege Terms and Conditions

1. Introduction

1.1. These terms and conditions ("Terms") govern your access to and use of the Capital on Tap Concierge Service (the "Service").

1.2. These Terms are in addition to our Rewards Terms and Conditions. All capitalised terms used in these Terms and not otherwise defined herein shall have the meanings assigned to them in the Rewards Terms and Conditions. 

1.3. Access to the Service is made available to eligible Capital on Tap Pro customers ("you", "your") by New Wave Capital Limited (trading as Capital on Tap) ("we", "us", "our").

1.4. The Service is operated and fulfilled entirely by Go Privilege (the "Service Provider"), an independent third-party service provider. Any use of the Service shall be governed solely by the Service Provider’s terms and conditions. We are unable to guarantee the continued access or availability to the Service, therefore we reserve the right to cease providing access to the Service at any time without any liability to us.

1.5. The Service consists of two components:

  • A complimentary Go Privilege Silver Membership (the "Membership"), which provides access to benefits and offers operated by the Service Provider; and

  • The option to use your Points as a payment method for certain goods or services ("Items") offered through the Membership.

1.6. By using the Service, you accept and agree to be bound by these Terms, including any relevant terms and conditions set out by the Service Provider (including their privacy policy).You may be required to accept these separately to activate and use the Service.

2. Our Role

2.1. Our role is strictly limited to that of a facilitator. We provide you with complimentary access to the Service if you are an eligible Capital on Tap Pro customer.

2.2. You acknowledge and agree that:

  • We are not the provider, supplier, or operator of the Service, the Membership, or any goods or services (including the Items) offered through it.

  • The Service Provider is an independent third party service provider, not an agent or employee of Capital on Tap.

3. Eligibility

3.1. To be eligible for and to use the Service, you must be an active Capital on Tap Pro customer in good standing, aged 18 or older, and a resident of the United Kingdom.

4. No Warranties

4.1. To the fullest extent permitted by law, access to the Service is provided on an "as-is" and "as available" basis, without any representations or warranties (other than those which cannot be excluded by applicable law), and cannot be transferred, exchanged, sold, or redeemed for cash.

4.2. As we are not the provider, supplier or operator of the Service, we therefore make no warranties or representations of any kind, whether express, implied, or statutory, regarding the Service, the Membership, or any goods, services, or benefits (including the Items) obtained through it. This includes, but is not limited to, any implied warranties of merchantability, fitness for a particular purpose, accuracy, timeliness, or availability.

5. Third-Party Suppliers

5.1. The Service Provider may use various third-party suppliers (e.g., restaurants, hotels, ticket agencies) to fulfill the benefits and offers within the Membership.

5.2. Capital on Tap is not responsible or liable for the acts, omissions, errors, or negligence of the Service Provider or any such third-party supplier, including for any delivery, quality, or safety of the Service or any Items obtained through it.

5.3. Your interactions with the Service Provider and any third-party suppliers are at your own risk. Any dispute, claim, or complaint regarding the Membership or any Item must be directed solely and exclusively to the Service Provider or the relevant third-party supplier.

6. Costs, Payments, and Redeeming Points

6.1. While access to the Membership itself is provided on a complimentary basis by Capital on Tap, you are solely responsible for all costs, fees, taxes, and expenses associated with any Items you purchase or book through the Service (e.g., event tickets, hotel rooms, travel costs, merchandise).

6.2. Unless you opt to pay with Points (where available), you will be required to provide a payment method directly to the Service Provider or the relevant third-party supplier to cover these costs.

6.3. For certain Items offered through the Service, you may be presented with the option to pay for the Item in full using your Points.

6.4. The option to pay with Points is only available if your Points balance is sufficient to cover the entire cost of the Item at the time of purchase. Partial payments, where an Item is paid for using a combination of Points and another payment method, are not permitted.

6.5. If you select to pay with Points, the total number of Points required for the Item will be confirmed by you and then immediately and irrevocably deducted from your Points balance. All such redemptions are final and non-refundable.

7. Limitation of Liability

7.1. To the fullest extent permitted by law, Capital on Tap, its directors, officers, employees, and agents shall not be liable for any loss, claims or damages of any kind, including but not limited to:

  • direct, indirect, special, incidental, punitive, or consequential damages;

  • loss of profits, loss of business, loss of data, or loss of goodwill;

  • damages arising from personal injury or property damage,

arising out of or in connection with your access to, use of, or inability to use the Service, the Membership, or any goods or services (including the Items) obtained through it, whether provided by the Service Provider or by the relevant third-party supplier, even if we have been advised of the possibility of such damages. You therefore agree to release us from all liability, loss or damage or expense arising out of or in connection with your access and or use of the Services, the Membership, or any goods or services (including the Items) obtained through it.

7.2. Nothing in these Terms shall exclude or limit our liability for death or personal injury caused by our negligence or for any other liability which cannot be excluded or limited under applicable law.

8. Data Privacy

8.1. To activate your Membership, we will need to share your personal information (such as your name, email address, and Capital on Tap account status) with the Service Provider. By using the Service, you consent to this sharing.

8.2. Once your data is shared with the Service Provider, their own privacy policy will govern their use of your data.

8.3. Our collection and use of your personal data are described in our Privacy Policy.

9. Termination or Suspension

9.1. Your access to the Service is contingent upon you remaining an eligible Capital on Tap Pro customer in good standing.

9.2. We reserve the right, in our sole discretion, to suspend, amend, restrict, or terminate your access to the Service at any time, for any reason, without prior notice and without any liability to you.

10. General

10.1. These Terms shall be governed by and construed in accordance with the laws of England and Wales.

10.2. You agree to submit to the exclusive jurisdiction of the courts of England and Wales to settle any dispute or claim arising out of these Terms.

10.3. We reserve the right to modify or replace these Terms at any time. We will provide notice of any material changes. Your continued use of the Service after any such change constitutes your acceptance of the new Terms.

10.4. If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed, and the remaining provisions will remain in full force and effect.
